THE MESSAGE
But if it was out in the country that the man found the engaged girl and grabbed and raped her, only the man is to die, the man who raped her. Don't do anything to the girl; she did nothing wrong. This is similar to the case of a man who comes across his neighbor out in the country and murders him; when the engaged girl yelled out for help, there was no one around to hear or help her.
New American Standard Bible (1995)
"But if in the field the man finds the girl who is engaged, and the man forces her and lies with her, then only the man who lies with her shall die.

Contextual Overview

13 Suppose a man marries a woman, has sexual relations with her, and then rejects her, 14 accusing her of impropriety and defaming her reputation by saying, "I married this woman but when I had sexual relations with her I discovered she was not a virgin!" 15 Then the father and mother of the young woman must produce the evidence of virginity for the elders of the city at the gate. 16 The young woman's father must say to the elders, "I gave my daughter to this man and he has rejected her. 17 Moreover, he has raised accusations of impropriety by saying, ‘I discovered your daughter was not a virgin,' but this is the evidence of my daughter's virginity!" The cloth must then be spread out before the city's elders. 18 The elders of that city must then seize the man and punish him. 19 They will fine him one hundred shekels of silver and give them to the young woman's father, for the man who made the accusation ruined the reputation of an Israelite virgin. She will then become his wife and he may never divorce her as long as he lives. 20 But if the accusation is true and the young woman was not a virgin, 21 the men of her city must bring the young woman to the door of her father's house and stone her to death, for she has done a disgraceful thing in Israel by behaving like a prostitute while living in her father's house. In this way you will purge evil from among you. 22 If a man is caught having sexual relations with a married woman both the man who had relations with the woman and the woman herself must die; in this way you will purge evil from Israel.

Gill's Notes on the Bible

But if a man find a betrothed damsel in the field,.... Alone, and where she might cry out, and none hear, nor were any to help her:

and a man force her, and lie with her; or "take fast and strong hold on her" b; so that she is not able to get out of his hands, and make her escape, he being stronger than she, and so commits a rape upon her:

then the man only that lay with her shall die; he being guilty of adultery, in lying with a woman espoused to another man, but not she, because she consented not to it.

b והחזיק בה "et apprehenderit (in) eam", Pagninus, Montanus; "et apprehendens eam", Piscator.

Clarke's Notes on the Bible

Verse Deuteronomy 22:25. And the man force her — A rape also, by these ancient institutions, was punished with death, because a woman's honour was considered equally as precious as her life; therefore the same punishment was inflicted on the ravisher as upon the murderer. This offence is considered in the same point of view in the British laws, and by them also it is punished with death.
