Contextual Overview

⁵ A man who has just married must not be sent to war or be given any other duty. He should be free to stay home for a year to make his new wife happy. ⁶ If someone owes you something, do not take his two stones for grinding grain—not even the upper one—in place of what he owes, because this is how the person makes a living. ⁷ If someone kidnaps a fellow Israelite, either to make him a slave or sell him, the kidnapper must be killed. You must get rid of the evil among you. ⁸ Be careful when someone has a skin disease. Do exactly what the priests, the Levites, teach you, being careful to do what I have commanded them. ⁹ Remember what the Lord your God did to Miriam on your way out of Egypt. ¹⁰ When you make a loan to your neighbors, don't go into their homes to get something in place of it. ¹¹ Stay outside and let them go in and get what they promised you. ¹² If a poor person gives you a coat to show he will pay the loan back, don't keep it overnight. ¹³ Give the coat back at sunset, because your neighbor needs that coat to sleep in, and he will be grateful to you. And if the man [be] poor,.... Which may be thought to be the case of everyone that gives pledges for a debt he owes, or a sum of money he borrows; yet there might be a difference: some might be so very destitute of goods and raiment in their houses, that whatever they parted with was distressing to them, and they could not well do without it:

thou shalt not sleep with his pledge; nor keep it a night; but deliver it to him, before he went to bed, and laid himself down to sleep.

Verse Deuteronomy 24:12. And if the man be poor, c. — Did not this law preclude pledging entirely, especially in case of the abjectly poor? For who would take a pledge in the morning which he knew, if not redeemed, he must restore at night? However, he might resume his claim in the morning, and have the pledge daily returned, and thus keep up his property in it till the debt was discharged Exodus 22:26; Exodus 22:26. The Jews in several cases did act contrary to this rule, and we find them cuttingly reproved for it by the Prophet Amos, Amos 2:8.
